Claim and subrogation review
Trace policy, payment, transfer of rights, and amount claimed to identify the correct debtor and legal basis.
When an insured debtor owes a confirmed insurance-related receivable and ordinary collection has stalled, PKPU may place the debt within a collective restructuring process. It is not a collection shortcut: the insurer must establish creditor standing, prove the amount, and weigh likely recovery against insolvency costs and risks.
This service is for insurers considering action against a corporate policyholder, insured party, or other debtor that cannot or will not pay an amount due. First identify what the debt represents: unpaid premium, deductible, reimbursement under a policy, or a subrogated claim after the insurer paid an insured loss. The policy, endorsements, claim file, payment evidence, and correspondence determine the legal basis and who may enforce it.
A subrogation file needs a clear link between the covered loss, the insurer's payment, and the rights asserted against the responsible party. A recovery claim against a third party is not automatically the same as a premium debt owed by a policyholder. Separate the claims, check limitation and dispute clauses, and reconcile principal, interest, and disputed items before choosing court action or restructuring.
A company has acknowledged a matured insurance receivable but stopped paying after formal demands.
An insurer has paid a covered loss and needs to assess whether its subrogated claim is enforceable against a third party.
The debtor has several creditors and appears unable to meet obligations as they fall due.
A proposed repayment plan needs creditor coordination rather than separate collection actions.
The insurer needs to compare settlement, a civil claim, and a PKPU petition before committing resources.
UU 37/2004 governs bankruptcy and PKPU. A PKPU petition is considered by the Commercial Court; a Surabaya matter may fall within Pengadilan Niaga Surabaya depending on jurisdiction and the debtor's legal domicile. Counsel will examine statutory creditor and debt requirements, petitioner identity, and whether the claim is genuinely due and payable. An insurer should not assume that an unresolved coverage dispute or contingent subrogation claim satisfies those requirements.
In PKPU, creditors submit and verify claims, then consider a debtor's composition proposal through the statutory process. The proposal may address payment schedules, compromises, security, or other terms. The court's role and the effects of voting and confirmation depend on procedural posture and applicable provisions. Bankruptcy, by contrast, involves collective administration and realization of estate assets by a curator. Neither process support undertakings payment; asset value, secured status, competing claims, and business viability matter.
Preserve policy wording, premium ledger or claim decision, proof of indemnity payment, subrogation documents, loss investigation, debtor acknowledgments, invoices, and demand history. Foreign insurers should also check authority to act, translations, governing-law clauses, and how evidence was executed. Indonesian proceedings may require locally usable documents and a properly authorized representative.
We map the debt and evidence before recommending a route. The review separates policy obligations from subrogation, tests the claim against contract and procedural requirements, checks available information about the debtor's assets and creditor structure, and identifies arbitration, jurisdiction, or limitation issues. Options can include documented settlement, ordinary civil proceedings, or an insolvency petition where statutory conditions appear supportable.
If PKPU proceeds, we prepare the petition or creditor submission, organize supporting records, attend claim verification and creditor meetings, and review composition terms. We also assess practical downside: a collective process may reduce control over timing and recovery, and a weakly documented claim can be disputed. Any recommendation depends on evidence, debtor position, and current procedural record.
Trace policy, payment, transfer of rights, and amount claimed to identify the correct debtor and legal basis.
Evaluate eligibility, forum, supporting documents, competing creditors, and alternatives before an insolvency filing.
Prepare claim materials and represent the insurer in claim verification and creditor discussions.
Compare repayment, security, conditions, and implementation risks against available recovery information.
Not automatically. Counsel must confirm that the premium is due, identify the contracting policyholder, and examine any coverage, calculation, or cancellation dispute. The statutory eligibility and evidence requirements under UU 37/2004 must also be assessed before filing.
Typically the policy and endorsements, claim investigation, proof of indemnity payment, documents showing the asserted subrogation right, loss and causation evidence, and prior demands. The precise set depends on the policy, responsible party, and whether liability is contested.
No. Recovery depends on verified claim status, creditor voting and court process, composition terms, assets, security, and competing claims. A plan may provide less or later payment than the face amount, and bankruptcy can produce a different distribution.
A foreign insurer should confirm authority to pursue the claim, local representation, document authentication and translation needs, and any contractual forum or governing-law clause. Those details are case-specific and should be resolved before filing or submitting a claim.
