Creditor Lawyer Surabaya — Debt Recovery & Security Enforcement

When a business borrower misses payment, the creditor must choose between a documented demand, a negotiated workout, enforcement of security, or court proceedings. Integra Law Office assists lenders and trade creditors in assessing those routes in Surabaya and East Java.

Professional and effective debt recovery.

Start by reconciling the debt: identify the borrower and guarantors, principal, interest and charges claimed, maturity and default dates, prior payments, and any dispute about performance. Collect the signed facility or supply agreement, amendments, invoices, delivery or acceptance records, account statements, support undertakings, and correspondence. A clear ledger and document chronology make it easier to distinguish an admitted balance from a contested one.

A somasi (formal demand letter) can state the contractual basis, amount claimed, supporting calculation, requested cure, and a channel for discussion. It does not itself create an enforceable court judgment. If discussions fail, counsel can assess a civil breach-of-contract claim in the competent Pengadilan Negeri, enforcement of properly constituted collateral, or—where statutory conditions are met—a petition in the Pengadilan Niaga Surabaya. These routes differ in proof, cost drivers, and effect on other creditors.

When creditors need a lawyer.

  • A borrower has missed an instalment or maturity date and the account needs a reliable balance calculation.

  • A trade customer disputes invoices, delivery, acceptance, or contractual set-off.

  • A lender is considering execution of registered fiduciary security or a Hak Tanggungan mortgage.

  • A guarantor denies liability or says the surety has expired or been discharged.

  • Several creditors are pressing the same distressed company and individual collection may reduce recovery options.

  • A debtor proposes restructuring but has not supplied current financial statements or a workable payment schedule.

Legal options for debt recovery.

For a contractual claim, the signed agreement and evidence of the creditor's own performance matter alongside proof of default and loss. The Civil Code provides the general contract framework; counsel should examine notice clauses, governing law, forum selection, acceleration terms, support undertakings, and limitation issues in the actual documents. A civil claim is generally brought in the competent district court, subject to any valid dispute-resolution agreement.

Security is a separate workstream. Fiduciary security depends on the deed and registration record; a Hak Tanggungan depends on its constitutive documents and land-registration record. The security instrument, debtor identity, asset description, priority, and any competing interests must be checked before choosing an enforcement path. Bankruptcy or PKPU (suspension of debt payment obligations) has distinct statutory eligibility and collective effects; it is not simply an ordinary collection shortcut.

How we recover debts.

We map the debt and security documents, verify the calculation, and identify the debtor's stated defenses before recommending a route. Where settlement remains realistic, we prepare a written proposal with payment dates, default consequences, and any required security or reporting terms; any amendment should be documented and signed by authorized parties.

If enforcement or litigation is considered, we organize evidence, check forum and service details, and explain procedural trade-offs for the creditor's decision. For insolvency proceedings, we separately assess statutory eligibility, claim evidence, and the effect on other creditors. No route ensures collection: the debtor's assets, priority, defenses, and cooperation affect the practical result.

Frequently Asked Questions

What should a creditor send for an initial debt review?

Provide the executed contract and amendments, invoices or drawdown records, account ledger, proof of delivery or disbursement, payment history, default notices, and security or surety documents. Identify disputed items separately rather than treating the full balance as admitted. Avoid sending original negotiable instruments until counsel confirms a secure review process.

Does a somasi force the debtor to pay?

A somasi records the demand and may be relevant to the contractual history, but it is not a judgment or an automatic seizure order. Its wording, delivery evidence, and any notice provision should match the contract. If the debtor disputes liability or does not respond, counsel can assess negotiation, litigation, or security remedies.

Can the creditor enforce collateral immediately after default?

That depends on the security type, its execution and registration, the contract, the asset, and any dispute over default or enforcement. The Constitutional Court's fiduciary-security ruling affects execution where default or voluntary surrender is disputed. Counsel should check the current instrument and facts before any repossession or auction step.

When might PKPU or bankruptcy be considered?

These are collective insolvency proceedings, not ordinary debt-collection letters. The statutory creditor and debt requirements, evidence, debtor condition, and consequences for all creditors must be assessed first. Filing strategy should account for the possibility of a restructuring process and the treatment of secured and unsecured claims.
